fitchek Privacy Policy

fitchek ("fitchek", "we", "us") provides AI virtual try-on services for online stores, including live try-on, photo try-on, and merchant analytics. This policy explains what personal information we collect, how we use it, and the choices available to you.
This policy covers two groups of people: merchants who install the fitchek app on their Shopify store, and shoppers who use the try-on experience on a merchant's store. If you are a shopper, the store you are visiting (the merchant) is the controller of your personal information, and fitchek processes it on the merchant's behalf. The merchant's own privacy policy also applies to you.
1. Information we collect
From shoppers using try-on:
- Camera frames and photos. Live try-on uses your device camera to render garments on you in real time. Photo try-on uses an image you upload. Uploaded photos, the generated try-on images, and any live try-on recording are stored securely and are automatically deleted within 14 days. Live camera frames used to render a real-time try-on are processed to produce the result and are not retained as a separate stream beyond the session.
- Contact details, if the store has enabled shopper capture. This may include your name and email address, provided by you before or during try-on. This is optional for merchants to enable and is always disclosed at the point of collection.
- Usage information. Which products were tried, when, on what device type, approximate country, and whether a try-on was followed by a purchase. This is used to give merchants analytics about their own store. Your IP address is not stored. Where you opt out of tracking through the store's cookie banner, device and location details are not recorded.
From merchants:
- Store name, domain, and contact details provided during installation.
- Product catalog data (titles, images, variants) accessed through Shopify APIs to power try-on.
- Billing is handled by Shopify. We do not receive or store your payment card details.
We do not knowingly collect information from anyone under 16. Try-on is not directed at children.
2. A note on camera data and biometrics
fitchek does not create, collect, or store biometric identifiers or biometric information such as facial geometry templates, face embeddings, or body-measurement data. Camera frames and uploaded photos are processed only to render the try-on you requested and are not used to identify you.
Before the camera activates for live try-on, your device asks for camera permission, and you are shown a clear notice about the try-on. You remain in control and can decline at any time.
3. How we use information
- To provide the try-on experience the shopper requested.
- To give merchants analytics about try-on activity on their own store (for example, most-tried products and try-on to purchase trends).
- To operate, secure, and improve the service, including debugging and abuse prevention.
- We do not use shopper photos, videos, or camera frames to train AI models, and your images are not shared for any training purpose.
We do not sell personal information, and we do not share it for cross-context behavioral advertising.
4. Who we share information with
- The merchant whose store you are shopping on.They receive try-on analytics and, if they enabled shopper capture, your contact details. Whether the merchant can view a generated try-on result depends on the consent choice you make in the try-on window (see section 5).
- Service providers that help us run fitchek, limited to what they need to host and operate the service (such as cloud hosting and AI processing infrastructure). Each is bound by a data processing agreement and may only process personal information on our instructions.
- Shopify, as the platform the app runs on.
- Authorities, if legally required, or a successor entity in a merger or acquisition, with notice where required.

5. Consent and your try-on results
The try-on itself is never blocked by consent — you can always use it. A consent choice in the try-on window controls one specific thing: whether the merchant can see the try-on result generated from your image. If you do not accept, the merchant does not see your generated result. This choice does not affect your ability to use try-on.
6. Where data is processed and stored
Personal information is processed and stored in India and Singapore. For shoppers in the European Economic Area and the UK, any transfer outside those regions is protected by Standard Contractual Clauses.
7. How long we keep information
- Shopper photos, generated try-on images, and live try-on recordings: automatically deleted within 14 days.
- Shopper contact details captured for a merchant: kept until the merchant deletes them or uninstalls the app, after which they are deleted within 14 days.
- Merchant account data: deleted within 14 days of uninstall, subject to legal retention duties.
- Aggregated analytics that identify no one may be kept longer.
8. Your rights
Depending on where you live (including the EEA, UK, California, and other regions), you may have rights to access, correct, delete, or receive a copy of your personal information, to object to or restrict certain processing, and to withdraw consent.
Shoppers: because the merchant is the controller, the fastest path is to contact the store you were shopping on. You can also contact us directly at support@tryfitchek.com and we will assist or forward your request to the merchant.

We support the Shopify data rights framework: when a merchant or shopper requests data access or deletion through Shopify, we respond through Shopify's mandatory privacy webhooks (customers/data_request, customers/redact, shop/redact) within the required timelines.
You will not be discriminated against for exercising any privacy right. Residents of some regions may also lodge a complaint with their local data protection authority.
9. Security
We use encryption in transit and at rest, access controls, and least-privilege practices to protect personal information. Access credentials are stored in encrypted form. No system is perfectly secure, but we notify merchants and authorities of breaches as required by law.
10. Changes to this policy
We will post updates here and revise the date above. For material changes affecting shoppers, we will work with merchants to provide notice.
